I don't agree. While I don't agree with this bill, without laws passed and challenged up to the supreme court, how would things change. I think the ban on marijuana is stupid but it is a federal law, and states have passed laws attempting to trump the federal law.

Ok, rights and obstruction of access, then.

Tangent, but how did Carter win West Virginia?

WV was/is a hotbed of Dem support thanks to strong ties between the Dem party and organized labor. Goes back to FDR times at least. Also, likely lingering Southern Democrat allegiances. WORKING CLASS WHITES. HARDSCRABBLE. BLAH BLAH.

Also, don't forget Carter was an evangelical and Reagan was a godless twice married Hollywood weirdo who consulted with astrologers. It's probably more notable that Reagan managed to so successfully use dog whistle politics to cement the Southern Strategy and convince the good people of the south to vote for a loopy actor from from the land of fruits and nuts.

The states aren’t trumping federal law, they’re just changing their own laws. Federal law is the same. Federal policy is changing as a result of Obama telling the DOJ/DEA to back off, and congress writing appropriations bills that limit the ability of the DOJ to prosecute medical marijuana cases in states that no longer ban medical marijuana.
 
Except maybe Idaho. They keep passing obviously unconstitutional stuff, then spending gobs of taxpayer money "defending" the "will of the people". Makes me so mad. If private attorneys take frivolous legal positions, they can have fees assessed against them. Personally as well as owed by their clients. I wish the US courts would hold our governor and state leg responsible and make them pay out of their own pockets back into the state fund.

the harmed parties/plaintiffs got their attorneys fees. But the people of the state of Idaho don't get their money back for this tom foolery. Man I loathe Butch Otter.

They are changing their own laws, but the still are not legal. Article VI of the constitution sees to that. The only reason all of the legalized marijuana states haven't been shut down is Obama telling the feds to back off. There were still federal raid on state legalized dispensaries in CA. If the next president doesn't feel the same way as Obama, the legal pot will be shut down.
 
Why should "biblically wrong" mean shit when determining the laws of a country with no official state religion? That is allegedly (partially) founded on the concept of "separation of church and state"?

It is only separation of church and state if you don't agree with that particular church right?
