WTF: Gibson files first infringement lawsuit

May I assume we are all now in favor of sanctions against plaintiffs who file nuisance intellectual property suits?

If Gibson would have filed the suit against Dean in 1977, when they started making the V and Z, then we would have a different story. As is stands, they started this suit in 2017. Dean has been making the guitars for 40 years.

Can they lose their trademark if the court says it took them too long to enforce it?

As seen in Detroit....

Let's show Gibson we're fed up with this BS! Please send me all your old Gibsons and I will destroy them in a secret location. For maximum effect, send only pre-Norlin era guitars, as I think that will make the biggest impression with those fat cats at Gibson.

yep, he's a freak, and a horrible interview, but makes a hell of a guitar. he's been cool when I've met him.
Nothing really bad or dickish. Just strange and really odd. Both he and Bryan Ewald were very night ce this past weekend. They approached me, I wasn’t going to talk to me. That Ewald guy cost me $1,600 though.

haha...nice. Ewald seems super nice, and he's a hell of a player. Mike Ault cost me about the same amount once.

So it's common knowledge that holders of trademarks must diligently defend them against any infringements or their trademark could be diluted and ultimately lost, right? And they defend them with cease and desist letters and ultimately lawsuits. And if you let companies infringe on your trademark and don't act for years, you can lose all claims to it.

So what's the controversy here? Maybe I missed something.

my guess is that smaller shops will obey the C&D until someone with more cash successfully exposes Gibson's lack of prior enforcement. Then the Vs will return. We shall see.

Yeah, he was extremely nice and seemed to truely enjoy his job. When I stopped back latter I’m the day Paul was gone, but Bryan was still there taking pictures and demoing products.
