Just recieved another cease and desist from Gibson, this time over the generic Firebird shape. We came to an agreement last year with the headstock change (which was much over due). They are also complaining that the logo I laser on the PG (which is a first gen Pontiac Firebird logo) is the same as theirs. It's not, but it kind of splits the difference between the Firebird and Thunderbird.

That's not an issue to me at all. Happy to change that up.

So we'll see. Honestly, I'm kind of happy to stop building them but they've become a pretty sizable chunk of my yearly production (about 10-25%).

I think Scott Holiday refusing to become an endorser two weeks ago caused this thwap0rotflmaorotflmaorotflmao

Honestly? I kind of wish it had happened 5 years ago when I still hated building them. LOL

It's not end of the world. I'll tweak the shape. Ironically, their trademark is only 3 years old, we've been doing them longer than that so I'll have to talk to the lawyer about it.

(BTW I'm not mad in the least, I think this is more funny than anything. I know the deal with trademarks, you enforce them or you loose them.)
 
you've got the right attitude about it, doug. to be expected when it comes to patents. so what body style tweaks are you thinking about?

Can we send a cease and desist letter to Gibson telling them to stop making crappy Firebird X's, crappy Les Pauls with flame/bowling ball graphics, etc.?

Or would that be asking too much?

I wish I would have trademarked it before them. That would have been hilarious!
 
I hate that Gibson sues everybody that makes things that people want when Gibson won't do it themselves.

That said, I'd rather rock a Banshee than give Gibson any money. I hope you can make them again in the future... And that I can rob a bank to pay for one.
 
This is your big chance to design a new iconic offset body. That said, it’s pretty shitty for Gibson to wait 48 years before filing for a trademark.

Doug, I like that you're going to take the opportunity to do something new. Shoulda trademarked it though. Wouldn't that have been a bitch? :grin:
 
That sucks, but it sounds like you are cool with it. I bet when you tweak it a little, it will be cooler anyways. Maybe some kind of cross between a firebird and an explorer.

I also agree with Kerouac that your designs are better anyways.
