I know that's not how trademarks work. LOL

However, like Doug said, he's been making them since before the trademark was filed. Prior art and all. It's why Fender can't make anybody stop making Strat and Tele bodies.

Here's the thing, I could probably go to court and show numerous examples of Firebird'esque guitars built before and after the trademark was filled by numerous companies (jackson, ibanez, greco, hertiage, lull, sully, hamer and about a dozen others). Gibson knows this. The deal is, they have more money to throw at lawyers than I do. They also know this. It's why they pick on small builders after learning a lesson suing PRS.
 
Damn. I really should have followed through on having you build me that black '76 Bicentennial version we talked about way back when.

At the time I just couldn't justify the expense, now I am really bummed that I didn't pull the trigger.

They'll probably be back. Slightly different looking but still great guitars.
